This agreement governs the rights and obligations of the parties regarding the sale and delivery of the digital cloud backup service ordered electronically through Kladim.
The service is activated electronically on the user's Kladim account once payment is successfully completed. There is no physical delivery or shipping.
For digital services whose performance begins immediately in electronic form, the withdrawal-right exceptions under applicable law may apply, provided the consumer's prior consent has been obtained. Mandatory consumer rights arising from a defective service remain reserved.
The service is provided together with the applicable end-user license terms. The user is responsible for safeguarding their encryption keys, account access, and the lawfulness of their own data.
For consumers, the legislation on the competent consumer arbitration committees and consumer courts applies. In commercial relationships, the jurisdiction terms specified in the agreement apply. The agreement enters into force on the date of electronic confirmation.
